ESL Resourse Closet Terms and Conditions

By joining the ESL Resource Closet, you agree to comply with and be bound by the following terms and conditions. Please read them carefully. If you do not agree to these terms, you should not continue with your purchase.
PERSONAL PAYMENTS
The ESL Resource Closet is a membership. Payments process automatically on the schedule you selected at the time of purchase (monthly, quarterly, or yearly) until you cancel.
FOUNDING MEMBER RATES
Founding member rates are offered only during early access. Your founding rate stays the same for as long as your membership remains active. If you cancel and later rejoin, you will pay the current membership rate, regardless of any founding or special rate you received before.
PURCHASE ORDER PAYMENTS
If you are using a school purchase order, your membership will begin on the date the Purchase Order is received by One Bilingual Teacher and terminate one year later unless a new purchase order or payment is received prior to that date. You will receive an invoice around the tenth month of membership.
If we do not receive a new purchase order or payment by the end of month twelve, your membership will be terminated and you will need to pay the current renewal price to get it reinstated. If your membership expires, you forfeit any special discounts you may have received the previous year.
CANCELLATION POLICY:
Because the Closet is a digital product that cannot be returned, www.onebilingualteacher.com has a no refunds policy.
If you are unhappy with your purchase for any reason, you can cancel any future payments as long as you submit your cancellation request at least 48 hours before the payment processing date. The billing process is automated, but the cancellation process must be handled manually, so we cannot guarantee that a request made within 48 hours of 12:00am EST on your billing date will be processed in time.
There are no partial or prorated refunds on monthly, quarterly, or yearly payments. Cancellations take effect once your request has been processed, and your access to the Closet ends at that time. If your current payment has already processed, we will not issue a refund for it. If you cancel and decide to join again later, you will be reinstated at the current membership rate, regardless of any special offers or discounts you received in the past.
1. Agreement.
This Agreement (the "Agreement") sets out the terms and conditions for access to and use of the ESL Resource Closet and the related website. We may change this Agreement at any time by posting the updated version, and changes take effect immediately. You can view the most recent version at any time at https://www.onebilingualteacher.com/closet-terms-and-conditions. Each use by you of the Closet means you accept this Agreement.
2. What You Get
Your membership gives you access to a library of teaching resources. Resources are delivered as links to Google Drive folders. We may add, update, reorganize, or retire resources at any time. We do not guarantee that any particular resource will remain in the Closet.
3.How You May Use the Resources
(a) Personal Use. Your membership is for one teacher. We grant you a limited, revocable, nonexclusive license to use the resources with your own students in your own classroom. You may print copies and assign digital copies to your own students.
(b) What You May Not Do. You may not share your login, the Closet links, or the files with other teachers, colleagues, or anyone else. You may not post the files or links on any public website, social media group, or file sharing site. You may not sell, resell, redistribute, or upload any resource, whole or in part, to any marketplace or site, including Teachers Pay Teachers. If your school or district needs access for more than one teacher, please contact us about a school license.
(c) Our Content. All content in the Closet is and remains the property of One Bilingual Teacher or its content suppliers and is protected by copyright and other proprietary rights. You do not acquire any ownership rights in any content through your membership.
(d) Other Uses. Any other use of the content, including copying, modifying, republishing, distributing, or creating derivative works, is prohibited without our prior written consent.
(e) Access. We may end your access to the Closet if you violate this Agreement. Use of the Closet is at the discretion of One Bilingual Teacher.
3. Disclaimers.
a) DISCLAIMER OF WARRANTIES. THE CLOSET AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." YOU AGREE THAT USE OF THE CLOSET IS AT YOUR OWN RISK. ONE BILINGUAL TEACHER DISCLAIMS ALL WARRANTIES OF ANY KIND, INCLUDING EXPRESS, STATUTORY, AND IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. YOUR SOLE AND EXCLUSIVE REMEDY RELATING TO YOUR USE OF THE CLOSET IS TO STOP USING IT. WE DO NOT WARRANT THAT THE CLOSET WILL BE UNINTERRUPTED, AVAILABLE AT ANY TIME OR FROM ANY LOCATION, SECURE, OR ERROR FREE, OR THAT IT WILL BE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. RESOURCES ARE HOSTED ON GOOGLE DRIVE, AND WE ARE NOT RESPONSIBLE FOR ANY INTERRUPTION, LOSS OF ACCESS, OR CHANGE IN GOOGLE'S SERVICES. YOU ARE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEMS OR LOSS OF DATA THAT MAY RESULT FROM DOWNLOADING ANY MATERIAL.
(b) LIMITATION OF LIABILITY. ONE BILINGUAL TEACHER SHALL NOT BE RESPONSIBLE OR LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES OR LOSSES, INCLUDING DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING FROM THE CLOSET, ITS CONTENT, OR YOUR USE OF EITHER, REGARDLESS OF THE TYPE OF CLAIM, EVEN IF ONE BILINGUAL TEACHER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE OR LOSS.
(c) EDUCATIONAL PURPOSES. The information in the Closet is intended for your educational use only. No guarantee is made that you will achieve any particular result from the resources. Please refer to your district or school rules before using any of the materials in your classroom.
5. Miscellaneous
(a) Prohibition Against Data Mining. You may not use data mining, scraping, crawling, email harvesting, or any process that sends automated queries to www.onebilingualteacher.com. You may not use the website or any materials to compile a collection of listings, including a competing product or service, or for any unsolicited commercial email.
(b) Intended Audience. The Closet is intended for adults only. It is not intended for children under the age of 18.
(c) Compliance with Laws. You agree to comply with all applicable laws regarding your use of the Closet. You also agree that the information you provide is truthful and accurate to the best of your knowledge.
(d) Indemnification. You agree to indemnify, defend, and hold harmless One Bilingual Teacher and our partners, employees, and affiliates from any liability, loss, claim, and expense, including reasonable attorney's fees, related to your violation of this Agreement or your use of the Closet.
(e) Testimonials and Feedback. Any testimonials, reviews, or feedback you submit to us may be used by One Bilingual Teacher in any way.
(f) DMCA Notice. If you believe your work has been copied in a way that constitutes copyright infringement, please send a notice to our Copyright Agent that includes all of the following:
1. An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest.
2. A description of the copyrighted work that you claim has been infringed.
3. A description of where the material you claim is infringing is located on the website.
4. Your address, telephone number, and email address.
5. A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
6. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
